1. Agreement to Terms
These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you," "user," "manager," or "player") and Khizrali Kradiya ("we," "us," or "our"), concerning your access to and use of the StatHoarder mobile application (the "Application"). By accessing the Application, you agree that you have read, understood, and agree to be bound by all of these Terms of Service.
IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, YOU ARE EXPRESSLY PROHIBITED FROM USING THE APPLICATION AND MUST DISCONTINUE USE IMMEDIATELY.
2. Apple App Store & Device Terms
The following terms apply when you use the Application obtained from the Apple App Store:
- Acknowledgment: This agreement is concluded between you and us only, and not with Apple Inc. ("Apple"). We, not Apple, are solely responsible for the Application and its content.
- Maintenance and Support: We are solely responsible for providing any maintenance and support services. Apple has no obligation whatsoever to furnish such services.
- Embargoes: You represent and warrant that you are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country.
- Third-Party Beneficiary: Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance, Apple will have the right to enforce these Terms against you.
3. Payments, League Dues, and Stripe Connect
StatHoarder facilitates the management of sports leagues, including the collection of real-world league dues.
- Nature of Payments: The Application facilitates payments for tangible, real-world sports services (such as league registrations, jersey costs, and field rentals) and does not provide digital content, premium app features, or virtual goods in exchange for league dues.
- For Players (Paying Dues): When you pay league dues through the Application, you are paying the League Manager directly via Stripe. StatHoarder applies a non-refundable 6% platform fee per transaction, displayed at the time of payment, to facilitate this transaction and maintain the platform. Standard Stripe processing fees (~3.4% + $0.30) also apply per transaction.
- For Managers (Collecting Dues): Payment processing services are provided by Stripe and are subject to the Stripe Connected Account Agreement. By operating as a Manager, you agree to be bound by these Stripe terms.
- League Commissioners are responsible for any tax obligations arising from payments received through the platform.
- StatHoarder is not responsible for any payment delays, holds, or account restrictions imposed by Stripe. All payment disputes related to Stripe account status must be resolved directly with Stripe.
- In the event of account termination, any pending refunds will be processed in accordance with our refund policy.
Refund Policy
StatHoarder does not hold league funds. Refund requests for individual dues payments must be directed to your League Manager. In the event a League Manager chooses to disband a league, StatHoarder will automatically process refunds to all paid members on the Manager's behalf via Stripe.
- Stripe (our third-party payment processor) retains their payment processing fee (~3.4% + $0.30) on all refunded transactions. This fee is non-recoverable.
- StatHoarder retains its platform fee on all refunds as it is non-refundable but players will receive their dues minus both fees.
- Players will receive their dues payment minus the Stripe processing fee and StatHoarder's technology fee to their original payment method.
- For Free Leagues (Vetting Fee): Payment processing services are provided by Stripe and is a $150 organizational vetting fee that is non-refundable once games are finalized. Managers will receive their refunds minus Stripe's fee (~3.4% + $0.30) if no games are finalized.
4. User-Generated Content & Acceptable Use (Zero Tolerance Policy)
StatHoarder allows users to create rosters, enter scores, send messages, images, and files via the League Chat feature.
- Zero Tolerance: There is no tolerance for objectionable content or abusive users. You agree not to post content that is defamatory, discriminatory, sexually explicit, harassing, or otherwise unlawful.
- Moderation: We provide in-app mechanisms to flag content and block users. We will act on reports of objectionable content within 24 hours by removing the content and/or ejecting the user.
5. Intellectual Property Rights
Unless otherwise indicated, the Application is our proprietary property. All source code, databases, functionality, software, designs, and graphics (the "Content") and the trademarks (the "Marks") are owned or controlled by us. Users are solely responsible for any content they upload, including team names, logos, and images. Users must not upload content that infringes on any third-party intellectual property rights.
6. Prohibited Activities
You agree not to:
- Systematically retrieve data to create or compile a database without written permission.
- Circumvent or disable security-related features.
- Trick, defraud, or mislead us or other users, especially regarding financial transactions or league standings.
- Reverse engineer, decompile, or disassemble any aspect of the Application.
7. Limitation of Liability
IN NO EVENT WILL WE BE LIABLE FOR ANY DIRECT, INDIRECT, OR CONSEQUENTIAL DAMAGES, INCLUDING PHYSICAL INJURY SUSTAINED DURING REAL-WORLD SPORTS ACTIVITIES ORGANIZED THROUGH THE APP.
We are not liable for any mismanagement of league funds by third-party League Managers.
Our total liability to you for any claim arising from or related to the Application shall not exceed the amount you have paid to StatHoarder in the twelve (12) months preceding the claim. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against StatHoarder.
8. Age Requirements & Children's Privacy
You must be at least 13 years of age to use the Application. Our signup process requires you to enter a date of birth and rejects any age below 13. If you are under the age of 18, you represent that a parent or legal guardian has reviewed and agreed to these terms on your behalf.
Individual leagues may set additional age requirements (e.g., "18+", "21+"). You may only join leagues for which you meet the age requirement based on the date of birth you provided at signup. Your date of birth is locked after signup; corrections require contacting us at takeover.to123@gmail.com.
We do not knowingly collect personally identifiable information from children under 13. If you are a parent or guardian and believe your child under 13 has created an account, please email takeover.to123@gmail.com. We will verify the request and delete the account and all associated data within 10 business days. See our Privacy Policy for full details.
9. Governing Law
These Terms shall be governed by and defined following the laws of the State of Texas. You irrevocably consent that the courts of Texas shall have exclusive jurisdiction to resolve any dispute.
